Although petty theft is commonly used in society to describe a variety of thefts, it only applies to a limited number of circumstances. For theft to be considered petty theft, the stolen item must be worth less than $500. Also, the person stealing the item must be legally allowed on the reisdence or property from which the item is stolen.
If the item worth more than $500, then it is not considered petty theft, and if the person stealing the item is not allowed on the property, then that person is charged with burglary.
People convicted of petty theft for the first time often receive deferred judgment and will likely be able to get the crime off their record. If people receive more than one petty theft convictions, then the punishments will likely be more severe.
